Introduction:

ZINGbikes.in is a trademark under RIFTMOTION PRIVATE LIMITED, (CIN: U74999TG2016PTC113075) which has been registered under the Companies Act, 2013, with the Ministry of Corporate Affairs since 2016. It is a leading and premier bike rental platform based in Hyderabad.

We offer a diverse fleet of two-wheelers with flexible short-term and long-term rental options, providing a convenient and affordable solution for daily commutes, weekend getaways, and city explorations

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY. BY ACCESSING OR USING THE PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREED TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, YOU MUST IMMEDIATELY DISCONTINUE USING THE PLATFORM AND THE SERVICES PROVIDED HEREIN.

Agreement Overview:

Under the BNS Act

This Agreement is entered into by and between:

  • The Agreement of services is entered between RIFTMOTION PRIVATE LIMITED (referred to as ZINGbikes.in) (hereinafter referred to as the “zingbikes” or “company” or “service provider” or “we” or “us” or “our”), a business entity registered under the applicable laws of Hyderabad, India, and offering bike rental services.
  • The individual or entity the vehicle (hereinafter referred to as the “Customer” or “Rider” or “User” or “user/s” or “you” or “your”).
  • Both parties agree to the following terms and conditions in accordance with the provisions of the BNS Act and any other applicable laws and regulations.

Definitions:

  • Service Provider: Refers to ZINGbikes, its owners, agents, employees, and affiliates.
  • Customer/Rider: Refers to any individual or legal entity entering into this Agreement to rent a vehicle provided by the Service Provider.
  • Vehicle: Refers to the bike rented under this Agreement, including all accessories and safety equipment (e.g., helmets) provided by the Service Provider.

Terms of Service:

  • Service Provider: (refers to ZINGbikes.in), its owners, agents, employees and affiliates.
  • Customer/Rider: refers to any individual or legal entity entering into this Agreement to rent a vehicle provided by the Service Provider.
  • Vehicle: refers to the bike rented under this Agreement, including all accessories and safety equipment (e.g., helmets) provided by the Service Provider.
  • The term “Platform” refers to all the websites (https://zingbikes.in/ or https://bookings.zingbikes.in/), site, site’s, services, applications and social media including those available on the Google Play Store/Apple App Store as ZINGbikes.in a company incorporated under the Companies Act, 2013 with Ministry of Corporate Affairs as M/s. RIFTMOTION PRIVATE LIMITED.

Terms of Service:

These Terms of Service (“Terms”) constitute an electronic record as per applicable laws and amendments relating to electronic documents and records in various statutes, including those under the Indian Information Technology Act, 2000. These Terms of Service do not require any physical, electronic, or digital signature.

By registering or using the Platform, you agree to be bound by these Terms and any other notices, disclaimers, guidelines, or agreements appearing on the Platform from time to time, including our Privacy Policy in our websites: (https://zingbikes.in/ or https://bookings.zingbikes.in/), collectively referred to as the “Terms and Conditions”. These Terms and Conditions constitute the entire agreement that governs your access to and use of the Platform. By accessing the Platform, you agree to comply with all applicable laws and regulations. Your continued use of the Platform constitutes your acceptance of these Terms and Conditions, including any revisions or updates.

Before using certain features of the Platform, you may be prompted to accept additional terms and conditions by clicking buttons such as “clicking/tick on an electronic button” or by “checking the tick mark on the acknowledge box” in the document manually/electronically “I Accept”, “I Agree”, “Okay”, “I Consent”, or other similar phrases. Any consent given in this manner will be deemed valid under all applicable laws.

Updation of Terms and Conditions:

Your use of the Platform is subject to these Terms and Conditions, which we may update, amend, modify, or revise from time to time. It is your responsibility to review the Terms and Conditions regularly to stay informed of any changes. Any updates to the Terms and Conditions will be effective immediately upon posting and will supersede any prior versions. The Company is not obligated to notify you of changes, but it is your responsibility to review these Terms periodically. By continuing to use the Platform and/or Services after the Terms have been updated, you agree to the revised Terms and Conditions. Any reference to “Terms and Conditions” shall refer to the most current version.

Scope of service:

Unlimited Kilometers:

Customers are allowed unlimited kilometer usage within limits during the rental period, subject to compliance with these terms and conditions.

Vehicle Delivery/Pickup:

Vehicles can be delivered/picked-up within a 20 km radius of the warehouse. Customers are required to pay separate delivery and pickup charges, which will be calculated based on the distance from the warehouse to the delivery/pickup location. The charges will vary depending on: The distance between the warehouse and the delivery/pick-up location for the delivery charges. The number of vehicles booked—for multiple or bulk rentals, charges will be determined based on both the distance and total number of vehicles.

Doorstep Delivery Process:

The Company will coordinate with the customer to set a delivery time for the vehicle. The customer must be at the specified location and time to receive the vehicle. Prior to accepting the delivery, the customer is required to test ride the vehicle. Once the vehicle is delivered, it cannot be returned. If the customer is not satisfied with the vehicle’s condition, they may request an exchange. While the Company conducts quality checks before delivery, the customer is responsible for inspecting the vehicle for any damages and must report any issues with photographic evidence to the Company’s representative. Delivery is contingent on vehicle availability. If the customer is unavailable or refuses delivery at the scheduled time, a rescheduling fee will apply. Furthermore, the Company reserves the right to refuse service to any customer deemed inappropriate by the Company or its authorized staff. The Company also reserves the right to suspend or terminate the customer’s registration, withdraw services, or impose penalties if the customer violates the Company’s policies or these Terms and Conditions, without affecting any legal rights or claims.

Doorstep Pickup Process:

Pickup arrangements will be made by mutual agreement. The customer must be present at the agreed time and date for the vehicle pickup, during which the vehicle will be inspected for damages. If the customer fails to return the vehicle as scheduled, a rescheduling fee of INR ₹200 (Indian Rupees Two Hundred Only) will be charged for each attempt.

Customer/Rider Responsibility:

  • Once the vehicle is handed over, the customer/rider is fully responsible for the vehicle and any accessories. The customer/rider must safeguard the vehicle at all times.
  • By using the rented vehicle, you (the User) agree to take full responsibility for any injuries, damages, or legal issues that arise. This includes accidents, property damage, breaking traffic laws, or violating these Terms and Conditions.
  • Any damage or theft is the sole responsibility of the customer/rider. The customer/rider is liable to pay for repair cost and/or vehicle cost incurred or the vehicle’s replacement cost, plus per-day rent for the days needed for repairs.
  • The customer/rider must report any accidents, damages, or mechanical issues to the ZINGbikes immediately.
  • In case of foul play necessary legal actions will be taken.

Rental Extensions:

  • Extensions must be informed and approved by the ZINGbikes. Unauthorized extensions will result in penalties, including daily rental charges and late fees.
  • Extensions are possible after paying the completed day’s rent and the advance rent for the next extension period. A maximum of two additional days is allowed.                   
  • Uninformed extensions over 2 hours result in a full day’s charge plus a late fee. Informed extensions under 6 hours are charged hourly (day’s fare divided by 24), while those over 6 hours are charged as an extra day.

No Refunds for Early Returns/Cancellations:

  • Ongoing Bookings: No refunds or deductions will be made for unused or if the customer/rider ends the ride prematurely.
  • Upcoming Bookings: If a rental bike booking is cancelled at least 24 hours before the scheduled start time by notifying ZINGbikes. cancellations are allowed for any reason. ZINGbikes will issue a 50% refund of the total payment made. The refund will be processed and transferred within 3 to 7 business days. And no refunds or deductions will be provided if the cancellation notice is given less than 24 hours before the scheduled booking start time.
  • If the customer fails to pick up the bike at the agreed-upon time and does not inform ZINGbikes within the specified grace period (5 hours), the booking will be considered a no-show, and no refund will be issued.

Eligibility for Exchange:

  • The exchange of vehicle request must be raised within the first 5 hours of receiving the vehicle or as soon as the

issue is identified.

  • The exchange is subject to the availability of an alternative vehicle of the same type or similar specification.
  • If the damage or service requirement is due to customer misuse, negligence, or an accident, the customer must first settle the repair costs. Additionally, the customer is required to pay a daily bike rental charge of ₹400, multiplied by the number of days it takes for the vehicle to be repaired and recovered, before a replacement vehicle is provided.
  • The repair cost will be determined after an inspection by ZINGbikes authorized personnel
  • If the replacement vehicle belongs to a higher category, additional charges may apply.
  • If the customer fails to pay the repair cost, the exchange request will be denied, and the customer must continue with the initially rented vehicle.

Modification Requests:

Customers may request a change in booking dates instead of cancelling. Changes are subject to vehicles availability and must be made at least 24 hours before the scheduled rental start time.

Payment Policy:

  • The customer is solely responsible for ensuring that all payments made are authorized and legitimate.
  • If a customer makes a payment using an illegal account, a third-party account without proper authorization, a stolen card, fraudulent means, or any other unauthorized payment method, strict legal action will be taken against them. Such actions are strictly prohibited, and ZINGbikes will not be held responsible for any consequences arising from such unauthorized or illegal transactions.

Payment Terms:

The User is required to make an upfront payment to the Company based on the invoice issued. The Company will generate the invoice for the Services provided to the User.

Payment Issues and Resolution:

In cases of repeated Auto-Debit failures or when the User’s selected payment method is no longer valid, the User must promptly provide an alternative valid payment method or agree to a mutually acceptable solution to settle any outstanding payments.

Non-Payment Consequences:

If the User fails to make the required payments or makes irregular payments, the Company reserves the right to cancel the User’s rental booking and/or discontinue the Services at its discretion, without prior notice.

Available Payment Methods:

The User acknowledges the availability of various payment options such as debit/credit cards, net banking, Unified Payments Interface (UPI), etc., during the transaction. The User also agrees that the Company is not liable for any loss or damage resulting from payment issues that arise due to the use of third-party payment gateways. However, the Company may assist the User in resolving any payment issues, but the User must take reasonable steps to promptly contact, cooperate with, and inform the Company about any payment problems encountered.

Transaction Fees and Regulatory Compliance:

All charges associated with the payment gateway and any related transactional fees will be subject to the relevant regulatory frameworks and directives set by the appropriate government authorities.

Right to Modify Terms:

The Company has the right to modify the subscription plans, tariffs, pricing structure, or any transaction-related terms under these Terms and Conditions at any time, for any reason, with proper notification to the User (either directly or through the Platform). The User acknowledges and waives any claims or rights that may arise under any contract, law, or equity in relation to such changes.               

Security Deposit:

The customer is required to make a deposit of ₹2000 after completing the ride when returning the vehicle. This deposit is intended to cover any potential fines or service issues that may arise during the booking period. The deposit will be refunded within 3 to 7 working days.

Helmets/Safety Gear:

  • Riders must wear a helmet at all times while riding for safety and compliance with traffic regulations.
  • We provide a complimentary helmet with every bike rental to ensure your safety. For pillion riders, an additional helmet is available at a nominal cost of ₹50 per day. Customers are responsible for returning all helmets in the same condition as received.
  • In case of loss, theft, damage, or failure to return a helmet, a replacement of INR ₹1100/- (Indian Rupees Eleven Hundred Only) will be charged by ZINGbikes.

Traffic Fines/Challan’s:

  • Any traffic fines/challans incurred from the ride start date and time to ride end date and time will be the sole responsibility of the customer.
  • It is the customer’s/rider’s responsibility to ensure the timely payment of any traffic challans (fines) incurred during the rental period. ZINGbikes will not be held liable for any such penalties, and failure to settle these fines may result in additional charges or penalties.

Prohibited Activities:

  • It is strictly prohibited to operate the vehicle under the influence of alcohol, marijuana or any other intoxicating drugs.
  • Under no circumstances are minors allowed to ride the bike. Any violation will result in immediate termination of the rental agreement and potential legal action.
  • Riders are also advised not use mobile phones while the vehicle is in the motion and to hold the handle with both hands all the times.
  • ZINGbikes vehicle is not to be used in any kind of race, competition, or for any illicit/illegal purpose.
  • The vehicles should only be ridden on paved roads. Off-road riding is not allowed.
  • ZINGbikes vehicles are strictly prohibited from being used for sub-rental purposes for third parties or any rental-related business activities. Legal action will be taken against the customer/rider who violate this policy.
  • ZINGbikes strongly recommends using high-quality petroleum from reputable stations. Do not use roadside petrol.

Passenger Rules & Speed Limits:

  • Riders must hold a valid driving license and all other documents that comply with local traffic laws and regulations while riding the vehicle.
  • We request our riders to strictly observe the speed limits and not to over-speed in any case.
  • The rider and pillion rider are themselves responsible for the safety of their lives at all times.

Passenger Limit:

  • Rider are not permitted to ride with more than one passenger behind them at any time.
  • Riders are not allowed to carry heavy luggage, heavy materials, or any items that can damage the vehicle. Overloading the vehicle is strictly prohibited.

Tampering with License Plates:

  • Any attempt to alter, modify, or tamper with the commercial license plates of a ZINGbikes vehicle including actions such as repainting them to appear non-commercial is strictly prohibited.
  • Such actions will be treated as a violation of the law and will result in legal action against the renter.

GPS Trackers Policy:

  • All GPS trackers installed in the vehicles of ZINGbikes are the exclusive property of the company.
  • These trackers are used solely for vehicle security purposes.
  • Each vehicle belonging to ZINGbikes is equipped with a GPS tracker. Any attempt to tamper with, remove, or disable the GPS tracker will be considered fraudulent activity.
  • In the event of such actions, ZINGbikes reserves the right to file a First Information Report (FIR) and initiate legal proceedings against the offender.

Insurance Policy:

  • The vehicle is covered under third-party liability insurance as per applicable laws.
  • This insurance covers damages or injuries to third parties but does not cover personal injuries, damages to the rented vehicle, or theft of personal belongings.

Liability for Accidents:

  • ZINGbikes is not responsible for any accidents occurring for any reason, mishaps occurring due to weather or nature, or police stopovers due to rider negligence or routine checks.
  • All traffic fines and challans during the rental period are the customer’s/rider’s responsibility.

Long Journeys:

  • For journeys above 50kms, from city the customer/rider is supposed to inform ZINGbikes in advance about it and is applicable extra charges.

Vehicle Inquiries:

  • If the registered user/rider is relocating during the rental period, they must keep ZINGbikes informed about their whereabouts.
  • ZINGbikes has the right to inquire about its vehicles and may contact the customer/rider occasionally to confirm the whereabouts and condition of the vehicle.
  • If a customer/rider doesn’t respond even after repeated intimations, it will be considered as foul-play, and necessary legal action will be taken against them.

Vehicle Return:

  • The vehicle will be thoroughly checked by the ZING executive while returning for any defects, damages, and abnormal fuel levels. Any such issues found would be levied on the customer/rider as per the loss.
  • For ZING by day bookings, customers/rider are requested to refuel the vehicles to the same level as at the time of delivery or picked by the customer/rider in case.
  • The vehicle must be returned in the same condition as it was rented, with all accessories and components intact.

Debt and Vehicle Possession:

  • In the event of any outstanding dues owed by the renter, the renter will remain fully responsible for the ZINGbikes vehicle, even if repossessed by a third party.
  • Daily rental charges will continue to apply until the vehicle is returned safely to ZINGbikes.

Unauthorized Modification of Number Plates:

  • If anyone attempts to change the commercial number plates of a ZINGbikes vehicle to private (white) plates, legal action will be initiated against the customer or renter.
  • Such actions are strictly prohibited and will be dealt with as per the applicable laws.

Fraudulent Activity:

  • ZINGbikes takes fraudulent activity seriously. If any suspicious or fraudulent behavior is detected, the rental bike may be automatically deactivated for security reasons.
  • A ZINGbikes representative will promptly contact the customer to conduct a thorough investigation and provide assistance in resolving the matter.

Ride Termination by ZINGbikes:

  • ZINGbikes reserves the right to end a ride if necessary. Customers/Rider must cooperate and settle the fare as per the end time.
  • All vehicles rented to the customers are the property of ZINGbikes, and ZINGbikes holds the right to terminate/cancel an ongoing booking and confiscate its vehicle in uncertain situations where violation of the given terms and conditions and where its vehicles are at risk.

Privacy and Data Protection

  • We collect personal information such as name, address, phone number, email address, legal documents/ ID proofs and payment details. This information is required to complete the registration process, facilitate transactions, and provide you with the services you request. The data you provide will be securely stored and used for the sole purpose of managing your rental experience and ensuring that we can provide a smooth and efficient service.
  • The personal information collected from you may be used for the following purposes:
  • To confirm your identity and ensure that you are eligible to rent a vehicle.
  • To process payments, confirm bookings, and handle billing or refund-related activities.
  • We may use your data to analyze rental trends, preferences, and customer feedback, helping us enhance the services we provide, improve user experience, and make our rental process more efficient.
  • Your personal data may be shared with authorized third-party partners and service providers, but only for the purpose of facilitating and improving the services we offer. These partners may include payment processors, insurance providers, and other operational entities necessary for the completion of your rental.
  • We ensure that any third parties with whom your data is shared are bound by confidentiality agreements and comply with data protection laws to safeguard your privacy.

Usage Restrictions:

Users of ZINGbikes.in are expected to adhere to certain guidelines to maintain the integrity and security of the platform. The following activities are strictly prohibited:

Violating Platform Integrity or Security: Users must not engage in activities that compromise the security, functionality, or reliability of the ZINGbikes.in platform. This includes hacking, exploiting system vulnerabilities, or attempting to disrupt service.

Transmitting Disruptive or Misleading Information: Posting, sharing, or disseminating content that could mislead, deceive, or confuse other users is prohibited. This includes false advertising, deceptive claims, or any content that may disrupt the platform’s operation or misguide users.

Submitting False or Incomplete Information: Users must ensure that all information provided on the platform is accurate, complete, and truthful. Providing false details or omitting critical information when making a transaction, creating an account, or interacting with others is not allowed.

Sending Unsolicited Messages to Other Users: Users are prohibited from spamming, sending unsolicited promotions, advertisements, or messages to other users. This ensures that the user experience remains positive and free of intrusive content.

Using Unauthorized Software, Tools, or Bots: The use of automated tools, software, or bots to interact with the platform in ways that were not intended by ZINGbikes.in is strictly forbidden. This includes scraping data, artificially inflating user activity, or automating interactions that would normally require human involvement.

Circumventing Security Features: Attempting to bypass or manipulate the security features in place on the platform, such as trying to access restricted areas or using vulnerabilities to gain unauthorized access, is not allowed.

Engaging in Unlawful Activities: Users are expected to comply with all local and international laws while using the platform. Engaging in activities that are illegal, fraudulent, or violate any applicable regulations is prohibited.

Consequences of Violations:

Account and Content Disabling: ZINGbikes.in reserves the right to disable or remove any content or suspend accounts found to be in violation of these Terms of Service. We take the integrity of the platform seriously and aim to maintain a secure and trusted environment for all users.

Data Preservation: In the event of a violation that may involve legal or regulatory matters, ZINGbikes.in may preserve relevant data for up to 90 days. This is done to assist with potential government investigations or legal proceedings as required by law.

Immediate Termination of Access: Users found in violation of these terms may face immediate termination of their account and access to the platform. We take breaches of platform integrity seriously to ensure the safety of all users.

Sharing User Data: ZINGbikes.in may, if required by law, share user data with affiliates, legal authorities, or other governmental entities. Sensitive personal data will be handled in compliance with applicable data protection regulations and standards to ensure your privacy and security.

Rules and Code of Conduct:

a. You should report any technical issues or problems encountered while using the Platform to the Company without delay.

b. Your account is for individual use only. Any third-party use is unauthorized and may result in the suspension of your account.

c. You must not (and should not allow any third party to):

Violate any applicable laws, regulations, or the rights of others.

Infringe on intellectual property or proprietary rights.

Engage in threatening, abusive, defamatory, fraudulent behavior, or impersonate any individual or entity.

Mislead or deceive about the origin of messages or information.

Upload or distribute harmful software, viruses, or any code that disrupts the functionality of the Platform.

Provide deliberately false or misleading information intended to harm individuals or entities.

Harm minors or provide content inappropriate for users under 18 years of age.

Threaten national security, public order, or break any laws.

Violate privacy or promote illegal activities.

d. You must not:

Place an excessive load on the Platform’s infrastructure.

Interfere with or disrupt the Platform’s operations.

Bypass security measures or access restricted areas.

Reverse engineer, decompile, or modify the Platform.

Copy, lease, or transfer Platform services to others.

Use the Platform to develop a competing service or website.

e. You are required to comply with all applicable local, state, and national laws and regulations while using our Services.

f. You must not use the Platform for any purposes that violate these Terms or any other rules or policies set by us periodically.

g. You are required to notify the Company immediately if your account is used without authorization or if there is a security breach.

Usage of Third-Party Sites:

  • Users may access third-party services through the Platform. The Company does not endorse, guarantee, or accept any responsibility for these third-party services.
  • Any interactions with third parties are done at the User’s own risk.
  • Clicking on links to third-party sites may lead you to external websites that have their own privacy policies and terms. The Company is not accountable for the content or practices of these external sites.
  • The Company holds the right to disable third-party links, but is not obligated to take such action.

User Interactions and Responsibilities:

  • The Platform may only be used for purposes explicitly allowed under these Terms.
  • Users are fully responsible for their interactions, including sharing personal or sensitive information.
  • The Company is not liable for any content or interactions generated by Users.

Notification System:

  • The Company offers automated alerts for service updates.
  • The Company does not guarantee the timely delivery or accuracy of alerts and is not responsible for any errors or failures in alert delivery.

Communication and Contact:

a. The Company may contact Users via phone, email, SMS or any other social media platforms for:

  • Service updates and notifications.
  • Feedback collection.
  • Resolving complaints or queries.
  • Informing Users of events or community activities.

b. Users agree to cooperate with the Company regarding communications.

c. Users consent to transactional communications in compliance with applicable telecommunications regulations.

d. Users shall indemnify the Company against any legal or regulatory issues arising from such communications.

By using the Platform, you agree to these Terms and Conditions.

Release of Liability:

By using the vehicle/service, you waive the right to take legal action against the Company or its affiliates for any injuries, damages, or losses that occur in relation to the use of the vehicle. This applies even if the issue was unexpected or caused by negligence.

Exclusions from Liability Limitations:

You acknowledge that the Company is not liable for any delays, service unavailability, or failure to meet its obligations under these Terms if the issue is due to:

  • Your lack of cooperation.
  • Your unavailability or failure to respond in a timely manner.
  • The provision of incorrect or incomplete information by you.
  • Delays in submitting required documents or information.
  • Events beyond the Company’s reasonable control.
  • Protection of the Company
  • You agree to indemnify and hold harmless the Company and its affiliates from any claims, lawsuits, or expenses (including legal fees) resulting from your use of the vehicle. If someone files a lawsuit against the Company because of your actions, you will be responsible for covering the associated costs.

Company’s Right to Defend Itself:

  • If any legal issue arises, the Company reserves the right to assume control of the case, and you agree to fully cooperate in such matters.

Severability and Waiver Explanation:

  • Severability – If any part of the Terms of Service is deemed illegal, invalid, or unenforceable in any state or jurisdiction, that specific section will be removed from the agreement. However, the remainder of the Terms will still be valid and enforceable.
  • Waiver – If the Company does not immediately enforce a particular right or provision, it does not mean that the Company has waived that right permanently. The Company may choose to enforce it at a later time.
  • Example: If the Company does not take immediate legal action when a user breaches the Terms, it does not mean that the Company forfeits its right to enforce that provision in the future.
  • This clause ensures that the agreement remains valid even if certain parts are invalidated by law and protects both parties from unintentionally waiving their rights.

Please note that for the purpose of validation, you shall be required to provide information (including, but not limited to, contact number or registered mobile number, etc.) for the purpose of validation and processing your service request.

Dispute Resolution:

  • Any disputes arising out of or in connection with this Agreement shall be resolved through arbitration as per the provisions of the BNS Act.
  • The decision of the arbitrator shall be final and binding on both parties.

Governing Law:

  • This Agreement shall be governed by and construed in accordance with the laws of India, specifically under the jurisdiction of Hyderabad courts.

Booking and Agreement:

  • By booking a ride, customers automatically agree to the Terms and Conditions of ZINGbikes.in, as outlined in this document. These Terms and Conditions are applicable but not limited to the following, and ZINGbikes.in M/s.
